The Agreement
These terms are the agreement between you and Capture Client ("we," "us") for your use of this website and the website-building service we sell on it.
By signing up, paying, or using the service, you agree to these terms. If you do not agree, do not use the service.
What We Do
Capture Client builds and maintains websites for service businesses. Our Growth Plan includes the initial website build, ongoing hosting, SSL and CDN, weekly new content, AI visibility monitoring, and a weekly email report.
We do our best work when you give us accurate business information in the intake form. Incomplete or inaccurate intake data can delay delivery and reduce the quality of what ships.
Eligibility
You must be at least 18 years old and legally able to enter a contract in your jurisdiction. You must sign up on behalf of a legitimate business you own or are authorized to represent.
Payment and Billing
The current price and offer are shown on our pricing page at the time you sign up. The Growth Plan is $499/mo, No setup fees. Cancel anytime.
We bill monthly via Stripe. The first charge runs on signup. Each renewal runs on the same calendar day the following month. Failed payments are retried a few times by Stripe. If we cannot collect after a reasonable retry window, we may pause the service and, after notice, cancel it.
All prices are in US dollars and exclusive of any applicable sales tax or VAT, which will be added at checkout where required. Pricing can change for future billing periods with 30 days' notice to active customers; current customers keep their current rate until the next billing cycle after the notice.
14-Day Money-Back Guarantee
14-day money-back guarantee, no questions. If you request a refund within 14 days of your initial purchase, we refund the full first month.
Refunded accounts forfeit access to the generated website and its static export. We take the site down and remove your files from our infrastructure. This policy applies to the initial purchase only. It does not apply to subsequent monthly renewals.
Cancellation and Hosting Window
After the first month, you can cancel anytime with no contract and no cancellation fee. Cancel via the customer portal or by emailing team@captureclient.net.
When you cancel (outside the 14 days refund window):
- Your website stays live on our hosting for 30 days after cancellation
- We provide a full static export of your site, ready to host anywhere
- After 30 days, we archive your site from our infrastructure
- You own your domain, content, and all assets, always
- We can help you move to self-hosting during the 30 days window
Hosting, SSL, and CDN are part of your active subscription. They do not continue as a standalone service after cancellation.
What We Commit To
- Deliver your initial website within 7 days of intake form submission
- Growth Plan: publish new pages weekly, informed by search and AI visibility data
- Growth Plan: send a weekly email report of what we shipped and where your site is showing up
- Keep your site hosted, secured (SSL), and delivered via CDN for the duration of your active subscription
- Respond to support emails within one business day
What You Commit To
- Provide accurate, truthful business information in the intake form
- Respond within a reasonable time to questions we need answered to do the work
- Only upload logos, photos, and brand assets you have the right to use
- Not use the service for anything illegal, fraudulent, defamatory, hateful, or in violation of a third party's rights
- Not attempt to reverse-engineer, attack, scrape at scale, or interfere with our infrastructure
- Not resell, sublicense, or white-label the service without our written agreement
Acceptable Use
The service is for legitimate service businesses. You may not use it to promote:
- Illegal goods or services in your jurisdiction
- Adult content, gambling, firearms, tobacco, vaping, or cannabis where prohibited
- Scams, multi-level marketing schemes, or deceptive business practices
- Content that infringes copyright, trademark, or another party's rights
- Spam or any form of automated abuse
If we discover a violation, we may suspend or terminate the service without refund. Repeated or serious violations may be reported to authorities where legally required.
Content and Ownership
Your content (the text, photos, logos, and brand assets you provide) stays yours. By using the service, you grant us a non-exclusive, royalty-free license to host, display, modify, and distribute your content solely for the purpose of building and operating your site.
The pages we build for you, and the words we write on them, become yours once your subscription is active. On cancellation, you receive a full static export of the site.
Our own software, tooling, brand, methods, content prompts, and research systems remain our property. Nothing in these terms grants you a license to our platform or internal tooling beyond running your own site.
Third-Party Services
Running your site depends on services provided by third parties, including Cloudflare, Google (Analytics, Ads, Maps, Fonts), Stripe, Resend, and Vercel. Their own terms and privacy policies apply to your use of their services. We are not responsible for outages, changes, or decisions made by those providers, and we will do our reasonable best to route around them when issues occur.
No Warranty on Search Results
We optimize your site for organic search and AI visibility using current best practices. We do not guarantee any specific ranking, traffic volume, lead volume, revenue result, or placement in Google, Bing, ChatGPT, Perplexity, Gemini, or any other platform. Search and AI platforms change their algorithms on their own schedule, without warning.
What we do guarantee: we publish the work on the schedule promised. The results depend on your market, your competition, your offer, and factors outside our control.
Except as expressly stated in these terms, the service is provided "as is" and "as available." We disclaim all other warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent allowed by law.
Limitation of Liability
To the fullest extent allowed by law, Capture Client's total liability for any claim arising from or related to these terms or the service is capped at the total amount you paid us in the 12 months before the claim arose.
We are not liable for indirect, incidental, consequential, special, or punitive damages, including lost profits, lost revenue, lost business opportunity, or lost data, even if we were advised of the possibility.
This section does not limit liability for fraud, willful misconduct, or any liability that cannot be limited under applicable law.
Indemnification
You agree to indemnify and hold Capture Client, our employees, and our contractors harmless from any claim, loss, or expense (including reasonable legal fees) arising from:
- Content you provide to us that infringes a third party's rights
- Your violation of these terms or of applicable law
- Your business activities, products, or services promoted on the site we build for you
Termination
You can terminate the service at any time by canceling in the customer portal or emailing team@captureclient.net. The Cancellation section above controls what happens to your site and data.
We can terminate or suspend the service if you violate these terms, if your payment fails for more than 30 days after notice, or if we are required to by law. We will give reasonable notice where possible.
The sections on ownership, warranty disclaimers, limitation of liability, indemnification, and governing law survive termination.
Governing Law and Disputes
These terms are governed by the laws of the State of Tennessee, USA, without regard to conflict-of-law principles. Any dispute arising from these terms or the service will be brought in the state or federal courts located in Knox County, Tennessee, and you agree to the personal jurisdiction of those courts.
If you are a consumer resident in the EU or UK, this clause does not override your right to bring a claim in the courts of your country of residence under mandatory consumer protection law.
Changes to These Terms
We can update these terms as the service changes. For material changes, we will email active customers at least 30 days before the change takes effect and update the "Last updated" date above. Your continued use after the effective date means you accept the new terms. If you don't accept, you can cancel.
